Commercial Permit
An ABC permit shall authorize the permitted activity only on the premises of
the establishment named in the permit. An ABC permit shall be issued to the
owner of the business conducted on the premise, or to the management company
employed to independently manage and operate the business.(Please refer to Qualifications.)
Before beginning business operations you must first obtain the appropriate
state permits/licenses, a federal basic permit or brewers notice issued by
Alcohol and Tobacco Tax and Trade Bureau (TTB) and a City/County business license.
The Commission shall consider numerous factors before issuing a permit. The
factors are as follows:

The reputation, character and criminal record of the applicant;

Parking facilities and traffic conditions in the neighborhood;

Kinds of businesses already in the neighborhood;

Whether the establishment is located within 50 feet of a church or public
school or church school;

Zoning laws;
-
Any other evidence that would tend to show whether the applicant would comply
with the ABC laws and whether operation of his business at that location would
be detrimental to the neighborhood.
To be considered for a permit you must submit the following:

Applications must be completed by typewriter or printed in ink.
Applicant’s signature must be notarized.

Correct Fees (Please refer to Permits.)
Application fees must be submitted by certified check, cashier’s check, or
money order and made payable to the North Carolina Alcoholic Beverage Control
Commission. All fees are deposited with the State Treasurer, and no provisions
are made for refunds whether the application is approved, rejected or
withdrawn. Permit fees must be separate and apart from all other fees.

Lease, deed or rental agreement
Lease, deed or rental agreement must be in the Corporate, LLC, General Partner,
Partner’s or Individual’s name.

Federal permits
All applicants must submit a copy of their Federal Basic Permit or Brewers
Notice issued Alcohol, Tobacco & Firearms.

Completed Inspection/Zoning Compliance form
The business site must comply with any county and/or city zoning laws, building
regulations, and fire regulations. Please have the Inspection/Zoning Compliance
form completed by the appropriate officials. Submit the completed form with
your permit applications. Please contact your local City Hall or County
Courthouse to determine whom you must contact for completion.

Detailed diagram of the premises to be covered by your permit. Please keep in
mind that an ABC permit cannot be issued where living quarters are directly
connected.

Each person that is required to complete an ABC Commercial Permit Application
must submit one (1) finger print card with the application.
