Ownership Types

The requirements for who must submit an application form with an application packet is dependent upon the structure of each business. Please see the applicant requirements for each business structure below:

  • Individuals: The Owner of the sole proprietorship must complete the application form.
    In addition, a non-resident applicant must execute a Power of Attorney appointing a NC resident to receive service of process and manage the business. This North Carolina resident appointed as attorney-in-fact must also complete an application form. The Power of Attorney must be filed in the county where the business is located and must be submitted with the permit application form.
  • Partnerships: Each partner must complete an application form.
    In addition, a non-resident applicant must execute a Power of Attorney appointing a North Carolina resident to receive service of process and manage the business. This North Carolina resident appointed as attorney-in-fact must also complete an application form. The Power of Attorney must be filed in the county where the business is located and must be submitted with the permit application form.
  • Corporations: The top four officers (President, Vice President, Secretary and Treasurer) and any other person or entity that holds twenty-five percent (25%) or greater stock in the corporation must complete an application form. The location site manager must complete an application form (unless application is for off premises retail permits).
  • Limited Partnerships: Each general partner must complete an application form. If a general partner is an individual, corporation, or LLC , submit applications according to the ownership guidelines listed.
  • Limited Liability Co.: If member-managed, all members holding a twenty-five (25%) or greater interest must complete an application form.
    • If manager-managed, certain members are selected to oversee the business and make all decisions. All managing members and anyone else who holds twenty-five (25%) or greater interest must complete an application form.
    • If the business is manager-managed by an outside entity, that entity may be an individual, partnership, corporation, limited partnership or LLC, submit application form in the name of this managing entity according to the ownership guidelines listed.
